Terms and Conditions

These Terms and Conditions apply to all services provided by Sun-Kissed Events (“Company,” “we,” “us,” or “our”), including its owner, employees, contractors, representatives, and agents. By submitting a booking, making a payment, signing an agreement, or participating in an event, the client agrees to these terms for themselves and their guests.

1. Bookings and Payments

A date is not reserved until the required payment or retainer has been received. Prices, services, guest counts, locations, and included items will be confirmed in the client’s invoice or booking agreement.

Retainers, custom purchases, personalized items, permit fees, food orders, and third-party vendor expenses are nonrefundable. Remaining balances must be paid by the deadline stated on the invoice. Late or incomplete payment may result in cancellation.

2. Cancellations and Rescheduling

Cancellation and rescheduling requirements stated in the booking confirmation or invoice will apply. No-shows and same-day cancellations are nonrefundable.

Approved rescheduling is subject to availability and may require additional fees. Payments may not be transferred to another person or event without written approval.

3. Weather, Tides, Locations, and Safety

Outdoor services are affected by weather, tides, waves, wind, heat, insects, public access, permits, and other conditions outside the Company’s control. The Company does not guarantee a particular sunset, view, beach condition, location, weather condition, or photographic result.

For safety, legal, environmental, venue, or operational reasons, the Company may relocate, modify, postpone, shorten, or cancel a setup. If the Company must cancel and cannot reasonably reschedule, the client will receive a refund or credit, less nonrefundable custom items, food, permits, labor already performed, and third-party expenses.

The Company may end an event without refund when unsafe, abusive, illegal, or destructive conduct occurs.

4. Client and Guest Responsibilities

The client is responsible for:

  • Providing accurate event, guest, dietary, hotel, and location information.

  • Obtaining required hotel, property-owner, venue, or government permission unless the Company agrees in writing to handle it.

  • Supervising children and guests at all times.

  • Following beach, park, hotel, venue, alcohol, fire, environmental, and public-safety rules.

  • Paying for damage, theft, excessive cleaning, missing rentals, fines, or penalties caused by the client or guests.

The Company is not responsible for unattended children, personal belongings, vehicles, parking, swimming, ocean activities, or guest conduct.

5. Food and Allergies

Food may contain or contact milk, eggs, wheat, soy, peanuts, tree nuts, seafood, meat, or other allergens. Although reasonable care may be taken, the Company cannot guarantee an allergen-free environment or prevent cross-contact.

Clients must disclose allergies and dietary restrictions before ordering. Clients and guests are responsible for deciding whether food is safe for them to consume. Perishable foods should be consumed promptly and discarded when they have been left outside safe temperatures.

6. Alcohol

Unless specifically stated in writing and legally permitted, the Company does not sell or furnish alcoholic beverages. Clients are responsible for complying with age restrictions, venue rules, permits, transportation requirements, and alcohol laws.

The Company may refuse or stop alcohol-related services when conduct appears unsafe or unlawful.

7. Rentals, Décor, and Property Damage

All reusable décor, furniture, tableware, equipment, and accessories remain Company property unless identified as purchased items.

The client is responsible for replacement or repair costs for lost, stolen, broken, stained, burned, or damaged Company property. The client is also responsible for damage to hotel rooms, beaches, parks, venues, homes, or other property caused by the client, guests, unauthorized decorations, adhesives, candles, confetti, glitter, food, or alcohol.

8. Assumption of Risk and Release

Clients and guests understand that outdoor and event activities may involve risks including uneven ground, sand, water, waves, tides, slippery surfaces, weather, heat, sun exposure, insects, wildlife, food reactions, falls, and the conduct of other people.

To the fullest extent permitted by law, the client voluntarily assumes these risks and releases the Company from claims arising from ordinary negligence or risks inherent in the event or location. This release does not apply to liability that cannot legally be waived, including gross negligence or intentional misconduct.

9. Limitation of Liability

To the fullest extent permitted by law, the Company’s total liability arising from a booking will not exceed the amount the client paid directly to the Company for that booking.

The Company will not be responsible for indirect, special, emotional-distress, lost-profit, travel, lodging, missed-flight, consequential, or third-party damages.

10. Indemnification and Third Parties

The client agrees to defend, indemnify, and hold harmless the Company from claims, damages, fines, expenses, and reasonable legal fees arising from the client’s or guests’ conduct, undisclosed allergies, unauthorized alcohol, property damage, rule violations, or failure to obtain required permission.

Independent caterers, photographers, hotels, transportation providers, tour operators, venues, and other vendors are responsible for their own services. Their separate terms may also apply.

11. General Terms

Hawaii law governs these terms. Any legal proceeding must be brought in the Hawaii county where the Company principally operates, unless applicable law requires otherwise.

If any provision is unenforceable, the remaining provisions will continue in effect. The booking confirmation, invoice, signed service agreement, and these terms form the entire agreement. Written booking terms control if they conflict with this general website policy.

Privacy Policy

Sun-Kissed Events (“Sun-Kissed Events,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, retain, and protect information when you visit www.sunkissedevents.org, contact us, request information, book an event, purchase products or services, or otherwise interact with us.

By using our website or providing information to us, you acknowledge the practices described in this Privacy Policy.

1. Information We Collect

We may collect the following types of information:

Information You Provide

This may include:

  • Your name, email address, telephone number, billing address, and contact information.

  • Event dates, locations, hotel information, guest counts, service selections, and special requests.

  • Dietary restrictions, allergy information, accessibility requests, and other information needed to provide services.

  • Transaction, invoice, deposit, refund, and booking information.

Please do not provide Social Security numbers, government identification numbers, medical records, passwords, or other information that is not reasonably necessary for your booking.

Payment Information

Payments may be processed by third-party payment providers. Those providers may collect payment-card and financial information under their own privacy policies and security practices.

Sun-Kissed Events generally does not receive or store complete credit- or debit-card numbers when payments are processed through a third-party payment provider.

Information Collected Automatically

When you use the website, our website platform and service providers may automatically collect:

  • Internet Protocol address.

  • Browser, device, and operating-system information.

  • Pages viewed, links selected, referring websites, dates, and access times.

  • Approximate location derived from an Internet Protocol address.

  • A buyer, successor, or other party involved in a merger, sale, reorganization, financing, or transfer of some or all of the business.

Service providers may use information only as permitted by their agreements, instructions, and applicable law. Independent businesses may have their own privacy practices, and Sun-Kissed Events is not responsible for those independent practices.

5. Sale and Advertising Disclosure

Sun-Kissed Events does not knowingly sell personal information for money.

Certain analytics, social-media, or advertising technologies, if enabled on the website, may collect or receive website-use information. Some state laws may define certain advertising or data-sharing activities as a “sale,” “sharing,” or “targeted advertising,” even when no money is exchanged.

Where applicable law gives you the right to opt out of these activities, you may submit a request using the contact information below. We will honor legally required browser-based opt-out signals when required and technically supported.

6. Email and Text Communications

We may use your contact information to send booking confirmations, invoices, reminders, service updates, and other communications related to your transaction.

Promotional emails may be discontinued by selecting the unsubscribe link in the message or contacting us. Transactional or booking-related communications may continue when necessary to provide services.

We will not send automated promotional text messages without any consent required by applicable law. Consent to receive promotional messages is not a condition of purchasing services. Message and data rates may apply.

7. Photographs and Social Media

We will not use identifiable client or guest photographs for marketing unless permission has been provided through a booking agreement, release, message, submission, or other authorization.

Information, photographs, comments, or content posted publicly on social media or submitted for public display may become publicly available. Do not submit content you do not have the right or permission to share.

Any photograph or media-release terms in a signed service agreement will also apply.

8. Data Retention

We retain personal information only for as long as reasonably necessary to:

  • Complete and document bookings.

  • Maintain tax, accounting, payment, insurance, and business records.

  • Resolve disputes and respond to complaints.

  • Enforce agreements.

  • Prevent fraud and protect safety.

  • Meet legal and regulatory obligations.

Retention periods may differ depending on the type of information and the reason it was collected. Information may remain in backups for a limited period after deletion from active systems.

9. Data Security

We use reasonable administrative, technical, and physical measures appropriate to the nature of the information we maintain.

No website, email, payment system, wireless transmission, or storage method is completely secure. Therefore, we cannot guarantee that information will never be lost, accessed, disclosed, altered, or misused.

To the fullest extent permitted by law, Sun-Kissed Events is not responsible for security incidents caused solely by third-party platforms, criminal activity, internet failures, user actions, or circumstances outside our reasonable control. Nothing in this section waives rights or responsibilities that cannot legally be limited.

10. Your Privacy Choices

Subject to applicable law and permitted exceptions, you may request that we:

  • Confirm whether we maintain personal information about you.

  • Provide access to certain information.

  • Correct inaccurate information.

  • Delete certain information.

  • Stop promotional communications.

  • Restrict or object to certain uses or disclosures.

  • Opt you out of legally defined sales, sharing, or targeted advertising.

We may need to verify your identity before completing a request. We may retain information when required for completed transactions, legal compliance, fraud prevention, recordkeeping, dispute resolution, or other lawful purposes.

We will not unlawfully discriminate against anyone for exercising an applicable privacy right.

11. Children’s Privacy

The website and our online booking services are intended for adults and are not directed to children under 13.

We do not knowingly collect personal information online directly from children under 13 without legally required parental consent. A parent or legal guardian who believes a child has provided information may contact us to request its review or deletion.

Parents and guardians are responsible for providing information about children who will attend an event and for obtaining any necessary permissions.

12. Third-Party Websites and Services

The website may contain links, integrations, booking tools, payment services, social-media features, maps, or content operated by third parties.

Sun-Kissed Events does not control and is not responsible for third-party websites, privacy practices, security, availability, content, or conduct. Review the privacy policy of each third-party service before providing information to it.

13. Visitors From Outside the United States

Sun-Kissed Events operates in the United States. Information provided through the website may be processed and stored in the United States or in other locations used by our service providers.

Visitors outside the United States are responsible for determining whether use of the website and transfer of their information complies with the laws applicable to them.

14. Changes to This Policy

We may update this Privacy Policy when our services, technology, vendors, or legal obligations change. The updated version will be posted on the website with a revised effective date.

Continued use of the website after an update constitutes acknowledgment of the revised policy to the extent permitted by law. When legally required, we will provide additional notice or obtain consent.

15. Relationship to Other Agreements

This Privacy Policy should be read together with our Terms and Conditions, booking agreements, waivers, invoices, photography releases, and other written agreements.

If a signed agreement contains additional privacy or information-use terms, those terms will also apply. This Privacy Policy does not waive or limit any consumer right that cannot legally be waived.

Refund and Rescheduling Policy

Effective Date: July 23, 2026

All bookings require a $100 nonrefundable booking fee. This fee reserves the selected date and covers initial planning and administrative costs.

All payments made to Sun-Kissed Events are final and nonrefundable. Sun-Kissed Events does not provide cash refunds, credit-card refunds, or partial refunds for cancellations, changes of plans, reduced guest counts, late arrivals, travel disruptions, personal dissatisfaction, or unused services.

Rescheduling

Clients may request one reschedule by contacting Sun-Kissed Events in writing at least 72 hours before the scheduled service.

The rescheduled event must take place within two weeks after the original booking date. Rescheduling requests outside this period will be treated as a cancellation, and all payments will be forfeited.

Rescheduling is:

  • Subject to staff, vendor, date, and location availability.

  • Limited to one reschedule per booking.

  • Nontransferable to another person or event.

  • Subject to current pricing and any additional vendor, permit, food, travel, rental, or replacement costs.

Payments already made, excluding the $100 nonrefundable booking fee, will be applied as a credit toward the approved rescheduled service.

If the rescheduled service costs more, the client must pay the difference. If it costs less, no refund or remaining credit will be issued.

Custom items, personalized products, food, flowers, permits, rentals, and third-party vendor expenses that have already been purchased or incurred may not transfer to the new date. The client may be required to pay these costs again.

Late Cancellations and No-Shows

Requests submitted less than 72 hours before the scheduled service are not eligible for rescheduling unless Sun-Kissed Events approves an exception in writing.

Failure to arrive, provide access to the location, obtain required permission, or communicate with Sun-Kissed Events will be treated as a no-show. All payments and rescheduling rights will be forfeited.

Weather and Unsafe Conditions

Outdoor events are subject to weather, tides, wind, waves, public access, venue restrictions, and other conditions outside the control of Sun-Kissed Events.

Sun-Kissed Events will determine whether conditions are unsafe or prevent the service from being reasonably performed.

When Sun-Kissed Events approves a weather-related reschedule, the new event must occur within two weeks after the original booking date, subject to availability.

Weather-related cancellations do not qualify for refunds. Clients who choose not to proceed when Sun-Kissed Events determines conditions are suitable will be subject to the standard cancellation policy.

Changes or Cancellation by Sun-Kissed Events

If Sun-Kissed Events cannot provide the scheduled service, the client will be offered a comparable service, booking credit, or rescheduled date.

Except where otherwise required by law, the client’s sole remedy will be rescheduling or a service credit. Sun-Kissed Events is not responsible for travel, lodging, transportation, missed reservations, lost income, emotional distress, or other incidental or consequential expenses.

Chargebacks

Clients must contact Sun-Kissed Events and make a reasonable effort to resolve billing concerns before initiating a payment dispute or chargeback.

Initiating a chargeback does not cancel the client’s obligations under this policy. Sun-Kissed Events may provide the booking agreement, invoice, payment records, communications, proof of purchases, and the accepted policy to the payment processor when responding to a dispute.

Acceptance

By submitting a booking or payment, the client confirms that they have read, understood, and agreed to this Refund and Rescheduling Policy.
